Director failed to remove all waste from a site using an authorized waste hauler, says government
One company director in Ontario has been fined $5,000 for a violation against the Environmental Protection Act.
Martin Hackborn, director of 2366352 Ontario Ltd., which operates as Deerfield Excavating and Trucking, was also tasked to pay a victim fine surcharge of $1,250. He was also given six months to pay.
In July 2020, the ministry issued an Order to Mr. Hackborn and the company, requiring the removal of waste materials that had been deposited at a site in North Dumfries.
“The deposited waste materials at the site were identified as foundry sand wastes, a by-product residue created from industrial processes that typically contain soluble chemicals and other chemical binders,” said the provincial government.
“Following a request for ministry review of the Order, a Director’s Order was issued to Mr. Hackborn and the company in August 2020.”
The Director’s Order required Hackborn to remove all waste from the site using an authorized waste hauler by September 2020.
However, between April 2022 and April 2023, the Ontario Ministry of the Environment, Conservation and Parks confirmed that the waste materials were still present at the site and had not been removed by a licensed waste hauler.
The ministry’s Environmental Investigations and Enforcement Branch investigated and laid charges which resulted in the conviction, said the government.
