London company faces fine for workplace injury

Delta Elevator Company Limited (Delta), a firm that manufactures, installs, and maintains elevating devices, has been fined $75,000 following an incident that resulted in the injury of one of its workers.

The incident occurred when a sub-contractor from Delta was tasked to do electrical work after the firm was hired to modernize two elevators of a multi-level apartment building.

The electrical worker needed to climb 13 flights of stairs from the broiler room in order to reach the elevator room. Delta workers had removed the metal guardrail on the landing at the top of the staircase, which meant that there were no barriers by the open side of the stairway.

When the electrical worker completed the installation of new lighting as well as other equipment in the elevator room, they threw cardboard waste down to the broiler room floor to clean up the work area. While doing so, the worker fell nine feet to the floor which had caused them to sustain multiple injuries.

The firm pleaded guilty to the Ontario Court of Justice, London for failing to ensure the proper measures and procedures that require a guardrail to be set up in the workplace.
