Employer charged as worker dies in boss’s property

Ontario employer Southgate Carpets has been charged with multiple violations after one of its construction workers died in the workplace.

The incident happened in September last year, when 62-year-old Ron Hill, a floor installer working for Southgate Carpets Inc., was working on a house being demolished.

The worker was struck by the scoop of an excavator being operated by another worker, reported CBC, citing a report from the Office of the Chief Coroner.

After being hit, Hill fell from the second storey and was later pronounced dead at hospital. However, The coroner's investigation found that Hill was without vital signs immediately after being hit and losing consciousness.

The incident happened on a property owned by Hill's boss on the city's eastern outskirts, according to the report.

The employer is facing four charges, including ones that relate to scaffolding and the installation of a fall protection system. The full details about the charges are available here.

“If it is not practicable to install a guardrail system as that subsection requires, a worker shall be adequately protected by the highest ranked method that is practicable from the following ranking of fall protection methods,” according to section 26.1(2) of Ontario Regulation 213/91.

Southgate's first appearance in provincial offences court is set for this Thursday, according to the CBC report.
