No signaller present while truck was reversing
York1 Millwick Transfer Limited pleaded guilty to one violation of the Occupational Health and Safety Act following a workplace fatality and has been fined $125,000.
The incident happened in January 2021 in the yard at 48 Millwick Drive in Toronto. A worker at the facility was struck and killed by a reversing truck that was attempting to dump a load of waste.
The Ministry of Labour, Immigration, Training and Skills Development says at the time there weren’t any traffic control procedures in place. “The driver of the truck did not have a full view of the intended path of the vehicle, and there was no signaller to provide direction at the time of the incident.”
The Ministry says the company failed as an employer to ensure measures and procedures in section 56 of Ontario Regulation 851 were followed, contrary to section 25(1)(c) of the Occupational Health and Safety Act.
The regulation states a signaller should have been stationed to direct the truck.
In addition to the fine, the court also imposed a 25 percent victim fine surcharge which is credited to a special provincial government fund to assist victims of crime.
